トランプ大統領は、２０２０年4月にアメリカ国民の雇用を守るため、グリーンカードの申請手続きを60日間停止する発表を行った後、２０２０年6月にはこの制限の延長に加え、２０２０年度末まで、一定のビザによる入国の停止を発表しました。以下に制限の内容を記載します。

例えば、6月時点でH-1ビザで滞在していて、その配偶者がH-2ビザを持っているが日本に滞在している場合、その配偶者の今後のアメリカ入国も可能であり、夫も滞在、就労に制限を受けることはありません。また有効期限内はもちろん出入国も可能です。

本件は、ビザの制限を課しているのであって、すでに保有している人のビザステータスを制限しているものではありません。ステータスの有効期限は、「I-94」に記載されています。その期間内であれば、延長が可能となります。

 

グリーンカードに関する制限も延長となっていますが、申請自体が停止されているわけではありません。就労を通してグリーンカードを申請する場合、「I-485」の申請を行えば、就労許可が発行され、正式なグリーンカードが発行されるまでの間、アメリカ国内に合法滞在、就労、出入国ができます。なお投資による永住権の申請（EB-5)は制限されていないようです。

本規制内容は今後、変更、延期の可能性があるとされていますので、十分に注意をして、適切な対応をしていくことが重要です。
